2012: "In response to USEPA requirements, the NYSDEC proposes to adopt a new Subpart 219-9 to the NY Codes, Rules and Regulations that impose significant requirements on operators of sewage sludge incinerators. These focus on monitoring a host of elements and compounds in the incinerator stack gases over and above those already monitored. The proposed Subpart 219-9 will require the City to commit to one of the two following schedules indicating that the City will either continue to operate the incinerator, submit an approvable control plan for compliance to the NYSDEC by September 21, 2012 and then achieve compliance 12 months after the State Plan approval or by June 21, 2013 (whichever is earlier); or elect to permanently close the incineration operation, by submitting a closure plan to the State by September 21, 2012 and then closing the operation 36 months after the State Plan is approved or by March 21, 2016 (whichever is earlier)."
