After beginning construction in 2006, the Robinson Power Company let construction lapse, invalidating the Beech Hollow Energy Project air permit. If developers of the Beech Hollow plant reapply, they will need to alter the project plans to meet improved air quality standards passed since the application was first filed in 2005.
In 2008 the Environmental Integrity Project and the Sierra Club brought a lawsuit against Robinson Power Company to meet federal and state pollution standards.
Robinson Power Company had planned to fuel the plant by burning the 37 million ton pile of waste-coal (the Champion Processing Inc. refuse pile) beside the proposed plant.
